Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Moniva mobile application and services ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Accounts and Security

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. Our Service provides features to view and manage active sessions across your devices. It is your responsibility to monitor these sessions and revoke access if you notice any suspicious activity.

2. Subscriptions and Billing

Access to certain features of the Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).

All billing and transaction processes are handled by the platform from which you downloaded the app (Apple App Store or Google Play Store) and are governed by their respective terms and conditions. We do not process or store your payment information. You must manage your subscription, including cancellations, directly through your App Store or Play Store account. Failure to maintain an active subscription may result in a loss of access to premium features.

3. Moniva AI Assistant

Our Service includes an AI-powered assistant ("Moniva AI") to help you manage your finances using natural language. By using Moniva AI, you acknowledge and agree to the following:

  • For Informational Purposes Only: Moniva AI provides summaries and performs actions based on the data you provide. It does not provide financial, investment, or legal advice. Its output is for informational purposes only.
  • Data Processing: Your conversations and financial data will be processed by our third-party AI provider (Google's Generative AI) to generate responses. This is done to execute your requests, such as creating transactions or providing analytics.
  • Accuracy Disclaimer: While we strive for accuracy, AI-generated content may contain errors or be incomplete. You should always verify the information and actions taken by the AI.

4. User Content

Our Service allows you to input and manage your financial data, including but not limited to transactions, accounts, debts, projects, and notes ("Content"). You are solely responsible for the Content you provide, including its legality, reliability, and accuracy. You retain all of your rights to any Content you submit.

By using the Service, you grant Moniva a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and process your Content solely for the purpose of operating, providing, and improving the Service. This includes using your data to provide you with analytics, generate AI responses, and maintain your account.

5. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
  • To attempt to compromise the security of the Service or other users' accounts.
  • To send spam, automated queries, or otherwise abuse our APIs, including our feedback, waitlist, and AI features.
  • To reverse-engineer, decompile, or otherwise attempt to discover the source code of the App.

6. Third-Party Services

The Service integrates with and relies on various third-party services to function. These include:

  • Google Play and Apple App Store: For application distribution and subscription management.
  • Google Generative AI: To power the Moniva AI assistant.
  • ExchangeRate-API: For currency conversions in analytics and transactions.
  • Resend: For sending transactional emails, such as waitlist confirmations.

Your use of our Service is also subject to the terms and privacy policies of these third parties.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You have the right to terminate your account at any time by using the "Delete Account" feature within the app. This action is permanent and irreversible. Upon confirmation, all of your Content and personal data will be permanently deleted from our systems in accordance with our data retention policies.

8. Disclaimer of Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Moniva provides no financial advice. The Service, including all analytics and AI-generated content, is for informational purposes only. You agree that your use of the Service is at your sole risk. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

9. Limitation of Liability

IN NO EVENT SHALL MONIVA, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
